Purpose
These general terms and conditions of sale apply without restriction or reservation to all online sales offered by LVF JB (hereinafter referred to as "LVF") on the website www.lvf.world (hereinafter referred to as "the Site").
The Site is an e-commerce platform that allows users (hereinafter referred to as "Buyers") to purchase sportswear, streetwear clothing, and sports accessories for sale on the Site (hereinafter referred to as "physical product(s)").
The site also offers the purchase of training videos and courses in sports, as well as athlete interview videos (hereinafter referred to as "digital product(s)").
The purpose of these general terms and conditions is to define the terms and conditions of online sales, delivery of Products (physical and digital), and to define the rights and obligations of the parties in this context.
These terms and conditions are accessible and printable at any time via a direct link at the bottom of the Site.
The applicable version of the general terms and conditions is the one accessible online on the Site at the time of the Buyer’s order.
These general terms and conditions of sale prevail over any other general or special conditions not expressly agreed to by LVF JB.
They may be supplemented, if necessary, by specific terms and conditions for certain Products (physical or digital) or services offered on the Site, which complement these general terms and, in case of contradiction, prevail over these latter.
2. Seller Identity and Contact Information
The Site, offering the Products (physical and digital) for sale, is operated by LVF JB, a limited liability company with a capital of €1,000.00, headquartered at 14 Chemin des Limites, 59122 Ghyvelde, registered with the Dunkirk Trade and Companies Register under number 937487890, represented by its manager, Mr. Jérôme Brysse (hereinafter referred to as "LVF JB" or "the Company").

3. Legal Capacity and Acceptance of Terms and Conditions
A) Legal Capacity
The Site is accessible to:

Any natural person with full legal capacity to commit to these terms and conditions. A person without full legal capacity may only access the Site with the consent of their legal representative.

Any legal entity acting through a natural person with legal capacity to contract on behalf of and for the legal entity.
B) Acceptance of the General Terms and Conditions
The Buyer’s acceptance of these general terms and conditions is evidenced by a checkbox on the order form. This acceptance must be full and unconditional. Any acceptance with reservations is considered null and void.
A Buyer who does not accept being bound by these general terms and conditions should not place an order on the Site.
4. Registration on the Site
LVF recommends that Buyers register directly on the Site to place an order. However, it is still possible to place an order without creating an account on the Site via "Guest" status. The steps for registration are outlined below to facilitate online ordering.
A) The Buyer may create a customer account to place an order on the Site by completing the form provided for this purpose. The Buyer must provide all mandatory information. Incomplete registrations will not be validated.
Registration automatically opens an account in the Buyer’s name (hereinafter: "Account"), allowing them to manage their purchases in a manner and by the means deemed most appropriate by LVF.
The Buyer guarantees that all information provided during the registration process is accurate, up-to-date, and truthful, and does not contain any misleading information.
The Buyer commits to updating this information in their Account if there are any changes (e.g., address change), ensuring that the information remains accurate.
The Buyer is informed and agrees that the information entered during the creation or update of their Account constitutes proof of their identity. This information binds the Buyer upon validation.
B) The Buyer can access their Account at any time by logging in with their login ID and password.
The Buyer agrees to use their Account personally and not allow any third party to use it on their behalf or for their account, except to bear full responsibility.
The Buyer is also responsible for maintaining the confidentiality of their login and password. Any access to the Site using these credentials is deemed to have been made by the Buyer. The Buyer must immediately contact LVF using the contact details mentioned in the "Seller Identity and Contact Information" section if they notice that their Account has been used without their knowledge. LVF reserves the right to take any appropriate action in such cases.
5. Characteristics of Products (Physical or Digital)
A) Products in Stock:
Before placing an online order, the Buyer can view the characteristics of each physical or digital product they wish to purchase on the Site.
Physical products are sold online subject to availability. Digital products are always available.
Photographs and descriptions of the Products are as accurate as possible. They only bind LVF for what is specifically stated. The Buyer is informed and agrees that certain characteristics, particularly the color, may not exactly match the photographs on the Site due to technical constraints.
B) Pre-Order Products (Special Case):
A pre-order is the process by which the Buyer selects the products they wish to purchase and have delivered. Products offered for pre-order are available only within the announced pre-order period, and only if the minimum announced number of pre-ordered products is reached.
A pre-order is finalized when the Buyer has selected the products they wish to pre-order, chosen delivery options, and made payment. Once finalized, the pre-order is handled by the Seller, who will proceed with manufacturing and shipping the pre-ordered products according to the terms of these General Terms and Conditions.
The pre-order offers presented by the Seller are only valid within the available time and quantity for pre-order. If the minimum goal for the pre-order campaign is not reached, the Seller will contact the Buyer at the end of the campaign to inform them of their decision to refund. In this case, the Seller will refund the Buyer within 14 (fourteen) days from the cancellation of the pre-order.
In the case of pre-orders, the manufacturing of these products only starts after the pre-order period, and only if the minimum manufacturing quantities are reached. Delivery times vary according to the type of product and its manufacturing requirements, and will be provided for guidance when purchasing the pre-order.
6. Order
A) Placing an Order
To place an order, the Buyer must select the desired product and add it to their cart.
The Buyer can review the details of their cart at any time before finalizing the order and can correct any errors in the entered information.
The order is deemed received by LVF when it can access it.
7. Prices and Payment Methods
A) Prices
The sale prices of the Products are displayed on the Site.
They are quoted in euros.
LVF reserves the right, at its sole discretion and under terms it deems appropriate, to offer promotional offers or discounts.
Prices do not include delivery fees, which are added to the cost of the Products. The applicable delivery fees will be indicated before the Buyer confirms the order.
8. Delivery
A) Delivery Territories
Buyers are expressly informed that the Site offers delivery to the following countries:

And more widely to any country where delivery is possible (subject to prior confirmation by the Seller).
9. Retention of Title Clause and Transfer of Risk
The Products remain the property of the Seller until full payment of the order price. However, the risk of the delivered goods is transferred to the Buyer upon physical possession of the Product by the Buyer or by a third party other than the carrier appointed by the Seller.
10. Buyer’s Obligations
The Buyer is solely responsible for the use they make of the Products. It is their responsibility to check the suitability of the Products for their specific needs before purchasing them.
11. LVF’s Responsibility
LVF commits to regularly performing checks to verify the functioning and accessibility of the Site. As such, LVF reserves the right to temporarily interrupt access to the Site for maintenance purposes. LVF cannot be held responsible for temporary difficulties or impossibilities in accessing the Site caused by circumstances outside its control, force majeure, or network disruptions.
LVF will not be held responsible for any failure or delay in the performance of the sales contracts due to circumstances beyond its control or force majeure, such as exceptional weather conditions, natural disasters, fires, floods, lightning, terrorism, riots, insurrections, wars, government actions, epidemics, network disruptions, or postal services, including strikes, as well as damages caused by viruses for which market security measures cannot eliminate.
12. Intellectual Property
The systems, software, structures, infrastructures, databases, and content of all kinds (texts, images, visuals, music, logos, trademarks, databases, etc.) operated by LVF on the Site are protected by intellectual property rights or database producer rights in force. Any decompilation, disassembly, extraction, reuse, copying, and more generally, any act of reproduction, representation, distribution, and use of any of these elements, in whole or in part, without LVF's permission is strictly prohibited and may result in legal action.
All elements of the site and products are and remain the intellectual property and exclusive property of the company.
No one is authorized to reproduce, exploit, redistribute, or use any part of the site, whether software, visual, or sound, or to share their personal login credentials with third parties.
13. Personal Data
LVF follows a data protection policy whose details are explained in the "Privacy Policy" document, which the Buyer is expressly invited to read.
14. Advertising
LVF reserves the right to place any advertising or promotional messages on any page of the Site and in all communications with Buyers, under conditions it deems appropriate.
15. Third-Party Links and Sites
LVF cannot be held responsible for the technical unavailability of websites or mobile applications operated by third parties (including its potential partners) accessed through the Site.
LVF does not endorse any content, advertising, products, and/or services available on such third-party sites and mobile applications, which are governed by their own terms and conditions.
LVF is also not responsible for transactions between the Buyer and any advertiser, professional, or merchant (including its potential partners) to whom the Buyer is directed through the Site and cannot be held responsible for any disputes with these third parties regarding product delivery and/or services, warranties, or obligations.
16. Prohibited Behavior
A. The following behaviors are strictly prohibited: (i) all actions likely to interrupt, suspend, slow down, or prevent the proper functioning of the Site, (ii) all intrusions or attempted intrusions into LVF's systems, (iii) any misuse of the Site's system resources, (iv) actions likely to impose a disproportionate burden on its infrastructures, (v) violations of security and authentication measures, (vi) actions likely to harm LVF’s financial, commercial, or moral rights, or the rights of its Site users, (vii) using the Site for purposes other than those for which it was designed, and (viii) any violation of these general terms and conditions or applicable laws and regulations.
17. Unsubscription
The Buyer can unsubscribe from the Site at any time by sending a request via email to LVF using the contact details mentioned in the "Seller Identity and Contact Information" section.
The unsubscription will take effect within a maximum of 7 (seven) days from this request. It will automatically delete the Buyer’s Account.
18. Modifications
LVF reserves the right to modify these general terms and conditions of sale at any time. In this case, the applicable terms will be those in effect at the time of the Buyer’s order.
19. Entirety of the Contract
These general terms and conditions represent the entire agreement between the Seller and the Buyer. If a provision of these terms is found to be invalid or declared as such by a decision of a competent court, or if any clause becomes null and void due to a change in legislation or regulation, the remaining provisions will remain in full force.
20. Applicable Law
These general terms and conditions are exclusively governed by French law. The terms are written in French. In case of a translation into one or more languages, the French text will prevail in case of a dispute. The Buyer also benefits from the protection of mandatory law in their country of habitual residence.
21. Disputes
In case of a dispute related to the conclusion, execution, or termination of an order, the Buyer can submit a complaint directly to the Seller via email in the first instance and by registered letter with acknowledgment of receipt in the second instance.
If an amicable resolution is not reached, the Buyer has the right to use a free consumer mediator for the amicable resolution of any dispute with LVF, under the conditions provided in Articles L611-1 and following of the French Consumer Code.

If no agreement is reached following the mediation procedure, the Buyer and/or the Seller may refer the matter to the competent courts.
22) Regarding Sports Camps
Montpellier Beach Volleyball, in association with Volleyeur Français and LVF JB, manages programs registered with the Regional Academic Delegation for Youth, Engagement, and Sports (DRAJES).
Camps and Travels: Our website details the programs offered, including information about destinations, accommodation types, travel, activities, and additional services. You will also find the dates, prices, payment terms, cancellation and modification conditions, and travel formalities. The all-inclusive prices cover all services listed in our programs.
Registration for Our Camps: Registrations are made through HelloAsso, and the link is available on our website. After registration and payment, a confirmation email along with the registration file will be sent to the client. If we do not receive all the documents and full payment before the start of the camp, we reserve the right to refuse the participant’s participation. For bookings made less than one month before the camp, full payment is required immediately.
We accept online payments by credit card via HelloAsso. For any requests concerning a different payment method, please contact our customer service at lvfvolleyballcamp@gmail.com or at +33 6 74 04 03 86. Payment installments may be possible (payment in 2-3 installments), and the terms will be set in writing after contact via email/SMS. However, the total amount of the camp fee must be paid one month before the start of the camp at the latest.
Cancellation Conditions:

100% refund minus €55 administrative fee for cancellations made more than 45 days before the camp starts;

50% of the camp cost minus €30 administrative fee for cancellations made between 45 and 15 days before;
-
25% of the camp cost minus €30 administrative fee for cancellations made between 14 and 6 days before;
-
No refund for cancellations made less than 5 days before the camp starts.
No refund is given for interrupted stays.
Cancellation and Modification by the Organizer: The camp may be canceled if the number of participants is insufficient. In case of major unforeseen circumstances, the camp details may be modified. Equivalent or superior services will be offered without additional cost, or a refund will be made for the services not provided, except for the administrative fees.
Internal Rules: Participants must adopt responsible behavior, respect the rules of conduct, adhere to schedules, and actively participate in the activities. In case of non-compliance, the organizer may notify the legal guardians and terminate the participant’s stay at their expense.
Regarding the internal rules, several points must be adhered to, as listed below:

Active Participation: Montpellier Beach Volleyball camps are designed to be dynamic, educational, and cultural, aimed at participants who wish to fully engage in activities. Each participant is expected to contribute positively by adhering to respectful behavior norms, essential in any social interaction, and by following the guidelines set by Montpellier Beach Volleyball and our partners and subcontractors. This includes respecting the rules of conduct, adhering to schedules, and actively participating in planned activities.

Discipline: All participants are required to show good conduct towards the coaching staff and other participants during all camp activities. Appropriate attire is required at all times. It is strictly forbidden to consume drugs, alcohol, tobacco, commit theft, use motor vehicles, or hitchhike. Any disruptive behavior or failure to comply with the rules of conduct and safety may result in notification to the participant's legal guardians and the termination of the camp at the participant's expense, including the costs of early return.

Liability Waiver: Once the camp is completed, our liability is limited to the period during which the participants are under our direct supervision. Montpellier Beach Volleyball disclaims any responsibility for incidents that may occur after the participants have been handed over to their parents or guardians.

Insurance: It is mandatory for participants to have civil liability insurance. Personal accident insurance is also recommended.

Medical Costs: Any medical costs advanced by the organizer must be reimbursed promptly by the participant's legal guardians, with supporting documents provided.

Use of Image: Images of participants taken during the camps may be used in our communication materials, unless a prior written objection is made by the legal guardians.

Personal Data Protection: In accordance with the applicable law, you have the right to access, modify, and correct the personal data concerning you.
